In the present writ application, the petitioner has sought for quashing of the order dated 29.12.2010, passed by respondent no. 4, the Mukhiya, Gram Panchayat Tenuj, P.S. Dinara, DistrictRohtas, whereby he has cancelled the appointment of the petitioner on the post of Panchayat Teacher in pursuance to Memo No. 3152 dated 25.08.2008, issued by the Department of Human Resources and Development, Bihar, Patna.

Learned counsel for the petitioner seeks permission to

Patna High Court CWJC No.3512 of 2011 (3) dt.11-07-2017 2/2 withdraw the present writ application with a liberty to prefer an appeal before the Member, District Teachers' Employment Appellate Authority, Rohtas at Sasaram, against the aforesaid office order vide Letter No. 3 dated 29.12.2010, passed by the respondent no. 4.

Permission is accorded.

The petitioner shall file an appeal before the Member, District Teachers' Employment Appellate Authority, Rohtas at Sasaram, within a period of thirty days from the date of the order which shall be disposed of in accordance with law within the statutory period.

The petitioner will be at liberty to file a separate application before the Member, District Teachers' Employment Appellate Authority, Rohtas at Sasaram, if so advised, for any interim relief.

With the aforesaid observation and direction, the present writ application stands disposed of.
