Petitioner seeks regular bail in connection with Dariyapur PS Case No. 166 / 2021 registered under Section 420, 467, 468, 471, 414 of the IPC.

As per the First Information Report upon seeing the Police Party one person started fleeing away and was apprehended after chase who disclosed his name as the petitioner. It has further been alleged that two trucks were found parked having same Registration No. bearing WB37D0019 but different Chesis No. and Engine No.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been implicated in this case by the Police. Learned counsel further submits that one of the trucks is owned by the petitioner and registration

Patna High Court CR. MISC. No.52214 of 2021(2) dt.22-04-2022 2/2 book has been annexed along with this bail application at Annexure- 2. Learned counsel next submits that petitioner has got no concern with the second truck bearing different Chesis No. and Engine No. but having the same Registration No. The petitioner is in custody since 01.04.2021 and charge sheet has already been submitted.

Regard being had to the submissions made by the parties and taking into consideration the material available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 01.04.2021, charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence if released on bail , as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- ( twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 13th or concern court Saran in connection with Dariyapur PS Case No. 166 / 2021.
