Mr.Zainul Abedin, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 08-10-2025 Heard learned counsel appearing on behalf of the petitioners and the learned APP for the State.

2. Petitioners seek pre-arrest bail in connection with Complaint Case No.2358 of 2019, registered for the offences punishable under Sections 406, 420 and 34 of Indian Penal Code.

3. As per the allegation made in the complaint petition, the informant gave Rs.30 lac to the petitioners and one Anil with an undertaking that they will return the entire amount within a period of six months but till date they have not returned the amount.

4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have been falsely implicated in the present case.

5. Learned counsel appearing on behalf of the complainant (O.P.No.2) submitted that OP No.2 has been put at loss by the act of the petitioners.

6. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

7. Considering the nature of allegation made in the complaint petition, as well as, the learned counsels appearing on behalf of both the parties finds it proper that the matter can be resolved by amicable settlement between the parties and for this the matter can be referred before the learned Mediator of the District Court so that the learned district court may refer the matter before the District Mediation Centre.

8. Both the parties are agreed to appear before the learned District Court on 19.11.2025 at 10.30 am.

9. Learned District Court is directed to take necessary action to refer the matter before the learned Mediator of the District Mediation Center.

10. Learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute

No.41317 of 2025(3) dt.08-10-2025 3/3 amicably and thereafter submit his/her report before the concerned learned District Court, well within a period of four months, till then, no coercive action shall be taken against the petitioners in connection with Complaint Case No.2358 of 2019.

11. In case of failure on the part of the petitioners to appear on 19.11.2025 at 10.30 am. before the learned District Court or any date fixed by the learned Mediator, the interim protection granted to the petitioners shall automatically lose its force and the District Court may take appropriate action in accordance with law.

12. In case, the parties fail to reconcile, then in that case, the parties may avail appropriate remedy in accordance with law.

13. Accordingly, the present bail application stands disposed of.
