This application, for grant of anticipatory bail, arises out of Rajpur P.S. Case No. 231 of 2015, disclosing offences under Sections 416, 420 and 109 of the Indian Penal Code.

Patna High Court Cr.Misc. No.41102 of 2016 (3) dt.28-09-2016 2/2 Earlier, the petitioner has approached this Court for grant of anticipatory bail, which was dismissed as withdrawn vide order, dated 17.05.2016, passed in Cr. Misc. No. 14639 of 2016.

Considering the allegation against the petitioner that he indulged in misappropriation of wheat to the tune worth Rs. 1,08,30,773.80/-, while working as In-charge of Paddy Purchase Center, Rajpur, Bharakhara, in the district of Buxar, I am not inclined to grant him the privilege of anticipatory bail.

This application is, accordingly, rejected.

The petitioner, above named, is directed to surrender before the learned court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
