Having regard to the fact that the petitioner has been compulsorily retired by way of punishment and an appeal against such order of punishment is still pending before the Executive Director of the Food Corporation of India, this Court, on being assured by Mr. Prabhakar Tekriwal, learned counsel appearing on behalf of the Food Corporation of India that such appeal, if not disposed of by the authority, shall be disposed of within a period of one month, would dispose of the writ application giving direction to the respondent-Executive Director of the Food Corporation of India, Kolkata to dispose of the appeal of the

Patna High Court CWJC No.13922 of 2015 (2) dt.04-09-2015 2/2 petitioner within a period of one month from the date of receipt of a copy of this order.

With the aforementioned observation and direction, this writ application is disposed of.

It will be, however, open for the petitioner to approach the appellate authority even in respect of any interim order for not taking any coercive step pending final disposal of the appeal. (Mihir Kumar Jha, J) Sujit/- U
