This application is for grant of regular bail in connection with Pasraha P.S.Case 142 of 2015, registered for the offences punishable under Sections 341, 323, 504 and 302/34 of the Indian Penal Code.

Allegation against the petitioner and one co-accused is of catching hold the deceased and thereafter the other coaccused have fired upon him. Submission of the learned counsel for the petitioner is that there is no allegation of assault against him. Para 16 of the case diary shows that he was not present at the spot at the time of occurrence and now he is in custody for about four months. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.33567 of 2017 (3) dt.09-08-2017 2/2 Having heard both sides and considering the active participation of the petitioner at this stage, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after framing of charge in this case. With the aforesaid observation, this application is dismissed.
