JUSTICE SANDEEP KUMAR ORAL ORDER 25-01-2023 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Pranpur P.S. Case No. 41 of 2021 for the offence under Sections 395, 397 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and his name has come in the confessional statement of co-accused. The petitioner is in custody since 16.04.2022. Mr. Bhola Prasad, learned counsel for the petitioner has produced a copy of orded dated 12.01.2023 passed in Cr. Misc. No. 56989 of 2022 by which similarly situated co-accused namely, Md. Jafar Ali @ Md. Jafar has been granted regular bail by a co-ordinate Bench of this Court.

In view of the reasons mentioned in the order dated

Patna High Court CR. MISC. No.42225 of 2022(3) dt.25-01-2023 2/2 12.01.2023 passed in Cr. Misc. No. 56989 of 2022, this application is also allowed.

The petitioner, named above, is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Katihar, in connection with Pranpur, P.S. Case No. 41 of 2021. Since the petitioner is from West Bengal, before releasing the petitioner, the court below will verify the residential address of the petitioner.
