The petitioner seeks bail in Chautarwa (Bathwariya) P.S. Case No. 61/2016, registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code. The informant is brother of the deceased. It is alleged that the sister of the informant was married with Raghwendra Yadav, who is son of the petitioner and from the said wedlock he was blessed with a daughter. After marriage, her husband and inlaws started demand of dowry and on account of non-fulfillment of the said demand she was subjected to cruelty and ultimately she was killed.
Learned counsel for the petitioner has submitted that this petitioner is mother of the husband of the deceased against
Patna High Court Cr.Misc. No.631 of 2017 (2) dt.11-01-2017 2/2 whom there is no specific allegation. The petitioner was not to be benefited by the alleged demand of motorcycle. The husband of this petitioner having similar allegation has been allowed bail in Cr. Misc. No. 41728/2016 and other co-accused, namely, Anil Yadav, who is brother-in-law of the husband of the deceased, has also been allowed anticipatory bail in Cr. Misc. No. 39719/2016. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Bagaha, West Champaran in connection with Chautarwa (Bathwariya) P.S.
