JUSTICE PRABHAT KUMAR JHA ORAL ORDER 31-07-2019 This petition is filed for modification of the order dated 16.01.2019, passed in Cr. Misc. No.80145 of 2018. The petitioner was directed to be enlarged on bail in the event of his arrest or surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order.

Learned counsel for the petitioner submits that the petitioner was living in Delhi to earn his livelihood and the Pairvikar of the petitioner could not inform him. The petitioner returned on 22.05.2019 and came to know about the fact but it appears that it is sheer negligence on the part of the petitioner and the petitioner even after being granted anticipatory bail did not surrender in the court below within four weeks.

Patna High Court CR. MISC. No.42680 of 2019(2) dt.31-07-2019 2/2 Having considered the facts, the period of surrender of the petitioner is extended for four weeks from today subject to payment of Rs.5000/- in the account of the Patna High Court Legal Services Authority.

The modification petition stands disposed of accordingly.
