ANJANA MISHRA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 02.08.2016 on his remand in connection with Samastipur Mufasil P.S. Case No.109 of 2016 corresponding to G.R. No.1150 of 2016 registered for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits though the petitioner has been taken into custody and there has been no recovery from his possession, yet on the basis of self confession made by him during the period of his custody in connection with another case, that the name of the petitioner was arbitrarily drawn in connection with the present case.

No.45232 of 2016 (3) dt.18-11-2016 2/2 Having considered the entire facts and circumstances and that the petitioner cannot be prosecuted on the basis of his own self confession made before the police, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samastipur, in connection with Samastipur Mufasil P.S. Case No.109 of 2016 corresponding to G.R. No.1150 of 2016.
