2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 420, 409 of the Indian Penal Code.

3. Petitioners are alleged to have defalcated the money of "Nal Jal Yojana".

4. It is submitted that petitioner No . 1 is ward member cum ward consular and petitioner No . 2 is Ward secretary of the concerned ward. It is next submitted that Panchayati Officer Patna has stated that work in question has already been completed and there is no question of

Patna High Court CR. MISC. No.43292 of 2023(2) dt.08-08-2023 2/2 misappropriation of money against these petitioners. In support of the submission, petitioners have filed " annexure 3 " of the bail petition. Petitioners claim clean antecedent.

5. Learned counsel for the State oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Court A C J M- VI, Patna City in connection with Gourichak P.S. Case No . 597 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
