30-09-2016 Heard Sri Shivendra Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is younger brother of the husband of the deceased, has prayed for grant of bail in Neemchak Bathani P.S. Case No. 127 of 2014 registered for offence under Sections 304(B), 201/34 of the Indian Penal Code, mainly on the ground that the husband of the deceased, against whom there was serious allegation than the petitioner, has already been granted bail by this Court, vide order dated 19-02-2016 passed in Cr. Misc. No. 57000 of 2015.

Learned counsel for the petitioner has further referred to order dated 05-11-2015, whereby, father-in-law of the deceased was granted bail by this Court, considering the fact that the sister

Patna High Court Cr.Misc. No.40875 of 2016 (2) dt.30-09-2016 2/2 of the informant (deceased) died due to ailment. Considering the fact that husband and father-in-law of the deceased have already been granted bail, there is no reason to detain the petitioner.

Let the petitioner namely Rabish Yadav @ Rabish Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Neemchak Bathani P.S.
