JUSTICE RAKESH KUMAR ORAL ORDER 29-09-2016 Heard Sri Shambhu Sharan Sharma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26.07.2016 in Paharpur P.S. Case No.46/2016 registered for the offence under Sections 420, 467, 468 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner is an illiterate person and without knowing the fact has sworn the affidavit.
However, Keeping in view the nature of accusation, period of custody as well as clean antecedent of the petitioner, as indicated in paragraph-3 of the petition, let the petitioner, namely, Mahendra Singh be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.40762 of 2016 (2) dt.29-09-2016 Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran ( Motihari) in connection with Paharpur P.S. Case No.46/2016.
