The petitioner seeks regular bail in connection with Khagaria (Gangaur) PS case no. 124 of 2017 registered for the offences punishable under Sections 399/402 of Indian Penal Code, 25(1-b)a/26/35 of Arms Act, 3/4 of Explosive Substances Act and 16/17/18/19/20/21/40 of U.A.P. Act.

The case of the prosecution is that upon secret information received by the police, a raid was conducted at the house of one Sanoj Yadav and four accused persons including the petitioner were apprehended while the rest of the accused persons fled away. The allegation of the prosecution is that one live cartridge was recovered from the possession of the petitioner herein.

Patna High Court Cr.Misc. No.39324 of 2017 (2) dt.19-08-2017 2/2 Learned counsel for the petitioner submits that the petitioner has clean antecedent and is in custody since 01.03.2017. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail especially in view of the long incarceration of the petitioner. The petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Khagaria in connection with Khagaria (Gangaur) PS case no. 124 of 2017.
