Patna High Court CWJC No.10950 of 2022(2) dt.22-03-2023 2/3 "1. That this is an application for issuance of a writ in the nature of mandamus or an appropriate writ for commanding and directing the respondents 1st set to remove the encroachment from Anabad Sarva Sadharan Land bearing khata No.150, Khesra/Plot No.707, Thana No.208, Area-32 decimal situated at village-Semra, P.S-Natwar, Anchal-Dinara, District-Rohtas at Sasaram which has been forcefully encroached by 2nd set respondents by making mud houses and huts and also direct the respondents 1st set not to settle the aforesaid land in favour of any person and/or for direction of any other writ/writs, order/orders, direction/directions for which the petitioner is legally found entitled in the light of facts and circumstances of the case."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Dinara, DistrictRohtas, for redressal of his aforesaid grievance. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Dinara,

Patna High Court CWJC No.10950 of 2022(2) dt.22-03-2023 3/3 District-Rohtas, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
