The petitioner seeks bail in anticipation of her arrest in connection with Mahila P.S. Case No.25 of 2016 instituted for the offences under Sections 736(D), 420, 468, 471, 34 of the Indian Penal Code & 66 of the I.T. Act.

Learned counsel for the petitioner submits that the petitioner is a lady and there is no specific allegation against the petitioner of having in any manner assisted the other co-accused in committing rape.

Taking into consideration that other co-accused has been granted anticipatory bail and regular bail by this court, including Md. Zaidi, who is alleged to have committed rape and also taking into consideration that F.I.R. has been registered

Patna High Court CR. MISC. No.51517 of 2021(2) dt.16-02-2022 2/2 after two years, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest, she shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
