2. The petitioners apprehends their arrest in a case registered for offence under Sections 304(B), 120(B), 34 of the Indian Penal Code.

3. As per F.I.R., all the F.I.R. named accused persons including petitioners demanded dowry of Rs. 5 lakhs and one motorcycle and due to non-fulfillment of the same, they committed the murder of daughter of informant by hanging.

4. Learned counsel for the petitioners submits that informant is no eye-witness to the occurrence. Petitioner no. 1 is Gotini (sister-in-law) and petitioner no. 2 is elder brother of husband of deceased. They are separate in mess and property

Patna High Court CR. MISC. No.49196 of 2024(3) dt.12-09-2024 2/2 and have got no concern with the affairs of deceased and her husband.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioners are named in the F.I.R. and there is specific allegation that these petitioners alongwith other co-accused persons committed torture to the deceased for dowry and lastly, killed the deceased by hanging her from fan. Deceased has died in an unnatural circumstances within seven years of marriage at her matrimonial house.

6. Considering the same, the prayer for anticipatory bail of petitioners is rejected.
