The petitioners are apprehending their arrest in connection with Parsa Bazar P.S. Case No. 49 of 2015 registered under sections 328, 302/34 of the Indian Penal Code. Case diary in the present case was called for which has since been received.

After hearing learned counsel for the petitioner and learned counsel for the State and on perusal of the entire case diary it appears that petitioner Chandni Devi, wife of Manoj Rai, her father Krishna Rai @ Krishnadeo Yadav, (petitioner no. 3) and her brother Laxman Kumar (petitioner no. 2) are having

Patna High Court Cr.Misc. No.40060 of 2015 (4) dt.17-02-2016 virtually no connection with the alleged occurrence. The only connection is that petitioner no. 1 Chandni Devi is wife of Manoj Rai, who is brother of the deceased.

Taking into consideration all the facts and circumstances of the case and also that they have no criminal antecedent, the petitioners above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Parsa Bazar P.S. Case No. 49 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
