The petitioner is languishing in custody since 20.06.2017 in a case for the offence registered under Sections 379 and 411 of the IPC.

The prosecution story, in brief, is that Attaché containing ornament and mobile of the sister-in-law (Bhabhi) of the informant was stolen away from the train. It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R.

Patna High Court Cr.Misc. No.42956 of 2017 (2) dt.21-09-2017 2/2 One stolen mobile is said to have been recovered. The said mobile has not been put on T.I. Parade.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Railway Court, Gaya, in connection with Gaya G.R.P. P.S. Case No. 35/12.
