The petitioner seeks bail in a case instituted under Sections 326, 302, 304, 406 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution story, in brief, is that husband of the informant was a property dealer and had advanced some money to one co-accused Vikash Verma and due to said money dispute, some unknown miscreants have killed the husband of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.09.2016. The charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.51367 of 2016 (3) dt.23-12-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. He has been made accused in the present case merely on the basis of suspicion. There is no substantive evidence to suggest his implication in the present case. The other coaccused have been granted bail vide Cr. Misc. No.50128 of 2016 and Cr. Misc. No. 51823 of 2016 by another co-ordinate Benches of this Court.
On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Buxar Town P.S.
