====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-07-2017 This application has been filed to modify the order dated 24-05-2017 passed by this court in Cr. Misc. No. 24207 of 2017.
It has been submitted that earlier by the aforesaid order, the petitioner was granted anticipatory bail by this court but in the order, one of the condition was that both the bailors should be close relative of the petitioner. It has further been submitted that the petitioner is a poor person and though petitioner has close relative but they have no property in their names to give sureties.
Prayer has been made to modify the order that one of the bailor will be maternal uncle and another will co-villager of the petitioner who are ready to become bailors of the petitioner. In such circumstances, this modification application is
Patna High Court Cr.Misc. No.35123 of 2017 (2) dt.26-07-2017 allowed to the extent that the one of the bailor must be maternal uncle and another should be co-villager of the petitioner. The time for surrender of the petitioner in the court below is extended for further four weeks from the date of receipt of the order. If the petitioner surrenders in the court below, he will be released on same terms and conditions as mentioned in the order dated 24-05-2017 passed by this court in Cr. Misc. No. 24207 of 2017.
