This application is for grant of bail in connection with Harsidhi P.S. Case No.245 of 2016 for the offence under Section 414 of the Indian Penal Code and Section 27(1-b)A, 26 and 35 of the Arms Act.
It is submitted on behalf of the petitioner that one Motorcycle and one Mobile Phone were recovered from the possession of the petitioner, as per the prosecution story and he is in custody for about six months. It is further submitted that though the petitioner is in custody in two other cases also but he is on bail in both the cases. It has also been submitted that other two accused persons have been granted bail by this Court. Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.48955 of 2016 (4) dt.20-02-2017 2/2 bail.
Having heard both sides. In view of the fact one Motorcycle and one Mobile Phone have been recovered from the possession of the petitioner and he is in custody for about six months. Considering the fact that one Motorcycle and one Mobile Phone have been recovered from the petitioner and he is accused in two other cases also, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after framing of the charges in this case. Accordingly, this application is dismissed.
