2. The petitioner seeks bail in connection with Chitragupta Nagar P.S. Case No. 123 of 2024 (G.R. No. 3471 of 2024) instituted for the offences under Sections 318(4), 338, 336(3), 340(2), 61(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per prosecution case, the accusation against the accused persons including the petitioner is of fraudulently selling the land of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case

Patna High Court CR. MISC. No.40437 of 2025(3) dt.09-09-2025 2/3 due to admitted land dispute. The petitioner is the bonafide purchaser of the land, in question, as he has purchased the same from Sahzadi Khatoon, one of the co-accused, after payment of consideration amount. He further submtis that for the disputed land, a Title Suit No. 02 of 2025 is pending before the learned Civil Judge, Senior Division, Khagaria which was filed by the petitioner and another against the informant and others. Chargesheet has been submitted in this case. The petitioner has three criminal antecedents and is languishing in judicial custody since 30.04.2025 without any rhymes or reason.

5. Learned counsel for the petitioner again submits that the co-accused namely Md. Shakir has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 30.07.2025 passed in Cr. Misc. No. 47204 of 2025.

6. On the other hand, learned A.P.P. for the State and the Informant have vehemently opposed the prayer for grant of bail to the petitioner.

Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the materials available in the case diary, the period of custody of the petitioner as also the fact that the co-accused having been granted anticipatory bail by a Co-ordinate Bench of this Court,
