The petitioner seeks bail in Madhawapur P.S. Case No. 30 of 2019, instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that on the date of occurrence Police party saw four Motorcycles coming from Nepal Border. On seeing the Police party, they started running away. Out of them petitioner has been arrested but others succeeded in running away leaving their Motorcycles. On search, total 684 litres of Nepali liquor has been recovered from the Motorcycles.

Counsel for the petitioner submits that petitioner is

Patna High Court CR. MISC. No.39479 of 2019(2) dt.01-07-2019 2/2 not owner of the Motorcycles. He has no concern with the recovery of alleged Nepali liqour.

Petitioner is in custody since 16.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IInd-cum-Special Judge, Excise Act, Madhubani, in connection with Madhawapur P.S. Case No. 30 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
