JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The petitioner seeks bail in connection with Katoria P.S. Case No. 50 of 2017 registered for offences punishable under section 8/20 (b)(ii)(B) of N.D.P.S. Act.
The allegation against the petitioner is that one vehicle was intercepted and three Kg Ganja was recovered from the dicky of the vehicle which was carried from Hazaribagh to Bhagalpur.
It has been submitted on behalf of the petitioner that three kg Ganja which was recovered is not under the commercial quantity and furthermore he is the passenger of the vehicle and nothing suspected article has been recovered from the possession of the petitioner. Petitioner is in custody for about two and half months.
Patna High Court Cr.Misc. No.33435 of 2017 (2) dt.25-07-2017 Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. However, learned Sessions Judge, Banka (Special Judge under N.D.P.S. Act) is directed to conclude the trial within a period of 9 months. In case the trial is not concluded within the said period, the petitioner would be at liberty to renew his prayer for bail.
With the above observation, this application is dismissed.
