The petitioner, already in custody, seeks bail in connection with Town P.S.Case No. 182 of 2018 registered under Section 381/34 of the Indian penal Code. Allegation in brief is that petitioner, a salesman of the informant's shop, committed theft of clothes and apparels and there is also recovery from him.
Learned counsel for the petitioner seeks bail on the ground of parity as other co-accused namely Ramakant Jha and Ravi Kumar have been admitted to bail by this Court as well as by co-ordinate Bench of this Court vide Cr. Misc. No. 44815 of 2018 and Cr. Misc. No. 40096 of 2018 respectively and also submits that petitioner was a hawker and used to take clothes from the informant on credit to sell moving from door to door and due to dispute relating to accounting, petitioner has been
Patna High Court Cr.Misc. No.41404 of 2018(4) dt.30-07-2018 2/2 implicated in a vindicative manner and remained in custody since 17.04.2018 and has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely , Manish Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Town P.S. Case No. 182 of 2018.
