Petitioner seeks bail in a case registered for the offences punishable under Sections 8/20(b)(ii)(B) of the N.D.P.S. Act and Sections 25(1-b)a/26/35 of the Arms Act. From possession of this petitioner and coaccused-Utam Singh, country made pistol, live cartridges, 10 Kgs of Ganja and some stolen ornaments were recovered while both were sleeping in a room at the referred Anganwari Centre. Petitioner is in custody since 20.03.2017. Petitioner is accused in several cases of serious nature. Case of the petitioner is distinguishable from co-accused-Ashok Ravidas @ Chhatri @ Ashok Kumar Ram,
Patna High Court Cr.Misc. No.13460 of 2018 (8) dt.30-07-2018 2/2 who has been granted bail by a Coordinate Bench of this Court in Cr.Misc.No.4183 of 2018 to the extent that he was sleeping in another room and no recovery was there from his possession.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Katihar Town Police Station Case No. 172 of 2017 corresponding to G.R.No.1005 of 2017 pending in the court of learned Sessions Judge, Katihar/successor court. Hence, prayer for bail is refused.
The learned trial court is directed to expedite the trial.
