KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner who is in custody seeks bail in connection with Jalalpur P.S. Case No. 73 of 2017 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and 2591-B)a, 26 and 35 of the Arms Act. It has been alleged by the informant in the FIR that on secret information he alongwith police persons reached at the place of occurrence, where they saw five persons assembled there with two motorcycles without number plates. Seeing the police party, four of them succeeded in fleeing away but one of them Jai Prakash Rai fell down and he was apprehended on the spot and the other four persons managed to escape. On search a loaded country made pistol alongwith three live cartridges were recovered
Patna High Court Cr.Misc. No.38987 of 2017 (2) dt.19-08-2017 from the apprehended person.
Learned counsel for the petitioner submits that petitioner was not arrested at the spot. It has been further submitted that the accused person who was apprehended on the spot disclosed the name of the petitioner and alongwith three others and he is in custody since 09.06.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -IX, Saran, in connection with Jalalpur P.S. Case No. 73 of 2017.
