Petitioner prays for bail in connection with Special Case No. 2427 of 2018, arising out of Ram Krishna Nagar P.S.Case No. 95 of 2018 registered for the offences punishable under Sections 395, 412 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act, including Section 30(a) of Bihar Prohibition and Excise Act.
Allegation as per FIR is that while informant was going in a tempo the tempo driver and five other miscreants on the point of firearm snatched from him Rs.10,500/-, mobile and other valuable documents and thereafter petitioner and other accused persons were arrested and from possession of petitioner one loaded pistol was recovered and further petitioner has criminal

Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and other coaccused Bharat Kumar has been granted bail by a co-ordinate Bench of this Court vide order dated 17.7.2018 passed in Cr.Misc.No. 42806 of 2018.

Having heard both sides and in view of nature of allegation, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case.
