JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Akilpur P.S. Case No. 57 of 2015 registered under Sections 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code. The accusation is that petitioner along with four others started to abuse Sanjay Kumar Thakur, brother of the informant when Sanjay Kumar Thakur made protest then all started to cause assault him. At that time, petitioner caused injury at his head by iron rod.
Learned counsel appearing on behalf of the petitioner submits that, in fact, there is land dispute in between the family members of the petitioner and informant and at the
Patna High Court Cr.Misc. No.42673 of 2015 (2) dt.09-10-2015 2/2 initiation of informant, proceeding under section 144 Cr. P.C. is going on, which was dropped in favour of the petitioner restraining the informant of the present case, while there is specific allegation against the petitioner and four others to cause injuries on the head of brother of the informant, Sanjay Kumar Thakur but all the injuries are found simple in nature caused by hard and blunt substance.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Danapur in connection with Akilpur P.S. Case No. 57 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J.) Shail/- U T
