====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Sasaram (Muffasil) P.S. Case No. 317/2020 registered for the offence punishable under Section 395 of the Indian Penal Code 1860.

The allegation, as per the First Information Report, is that six miscreants riding on two Motorcycles intercepted the informant and snatched a Mobile Phone, purse containing Rs.1809/-, ATM Card etc.

Learned counsel for the petitioner submits that from perusal of the First Information Report it is evident

No.51611 of 2021(2) dt.15-04-2022 2/3 that miscreants were covering their face with towel and no Test Identification Parade has been conducted by the Police despite the fact that the petitioner is in custody since 18.4.2021. Learned counsel further submits that name of the petitioner has transpired on the basis of confessional statement of co-accused Himanshu Yadav and self inculpatory statement of the petitioner was also recorded. He next submits that no incriminating article has been recovered from the petitioner and the petitioner is in custody since 18.4.2021.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner is in custody since 18.4.2021, charge sheet has already been submitted and the petitioner is on bail in two other cases lodged against him, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram
