JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 09-11-2015 The whole premise on which the present writ application was based against the transfer of the petitioner from S N S R K S College, Saharsa to University Headquarter was that such transfer has been done contrary to rules and law.

The counter affidavit of the University has been filed, rebutting the position, to bring on record a statute by which the ViceChancellor has been vested with the power of transfer of Class III and IV employees from one place of posting to another. If it is so and if the statute is in vogue since 2013, the law prevailing prior to that position is of no avail.

In view of the same, the order of transfer is not required to be interfered with. Let the petitioner join the transferred place of

Patna High Court CWJC No.13585 of 2015 dt.09-11-2015 2 / 2 posting without further delay.

Writ is otherwise dismissed.
