JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-10-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 147, 148, 149, 341, 307, 324, 326 and 302 of the I.P.C, section 3⁄4 of the Explosive Substance Act and section 27 of the Arms Act.

As per the First Information Report the petitioner was only member of the mob. There is no allegation against him either to open fire or to explode bomb. Specific allegation is against other co-accused.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like

No.41629 of 2016 (2) dt.05-10-2016 2/2 amount each to the satisfaction of the Additional Sessions JudgeIV, Siwan in Sessions Trial No. 137 of 2016 arising out of Guthani P.S. Case No. 83 of 1996, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
