Petitioner apprehends arrest in registered for the offences punishable under Section 376 and other allied sections of the Indian Penal Code and section 8 of the POCSO ACT. As per the prosecution case petitioner entered into the house of the informant when she was alone and tried to outrage her modesty.

Submission is of false implication. Victim is measure and there is variation in F.I.R. and statement of victim with regard to place of occurrence. Petitioner has no previous criminal history.

Learned counsel for the State opposes the prayer for bail.

No.51459 of 2021(3) dt.27-06-2022 2/2 Considering the specific allegation against the petitioner, in the F.I.R as well as acquisition made by the victim in her Section 164 Cr.P.C statement, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
