2. The petitioner has filed the instant application for apprehending his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

3. As per the F.I.R. there is specific allegation against the accused persons including the present petitioner is that they have defaulcated and misappropriated the government amount of Rs. 3,54,091/- meant for Nal-Jal Scheme.

4. Learned counsel for the petitioner submitted that the petitioner is ready to deposit the said amount in six installments within one year. The petitioner will deposit the same amount in the concerned Block from where he has withdrawn the said amount.

8. Keeping in view the aforesaid facts and submissions made by the learned counsel for the petitioner, this Court is inclined to enlarge the petitioner on provisional bail. The above named petitioner is directed to be enlarged on provisional bail in connection with Barachatti (Mohanpur) P.S. Case No. 603 of 2022, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned learned Additional Chief Judicial Magistrate - I, Sherghati, Gaya, after producing the certificate of depositing the first installment of Rs. 1,00,000/- (One Lakh).

9. Trial Court is directed to confirm the provisional bail granted to the petitioner after verifying the deposit receipts of payment of the entire amount i.e. Rs. 3,54,091/- by the petitioner to the concerned Block from where he has withdrawn the said amount. In the meantime, petitioner will have to appear in the Court physically on each date.

10. Accordingly, the instant application stands disposed of.
