JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 22-02-2017 Heard learned counsel for the appellant as well as learned Special Public Prosecutor.

So many persons including appellant are being prosecuted on account of an allegation having attributed against them to have employed the Members of Scheduled Caste under bonded labour and further, for that they were/ are being given remuneration less than prescribed by the Government in terms of Minimum Wages Act.

The learned lower Court had rejected the prayer for grant of bail vide order dated 22.08.2016 in connection with Alipur P. S. Case No.60 of 2014 whereupon instant appeal has been preferred in terms of Section 14A of the Act. Furthermore, it is evident from the order impugned that appellant happens to be under custody since 28.07.2016.

APP (SJ) No.912 of 2016 (03) dt.22-02-2017 That being so, setting aside the order impugned, appellant, Ram Vinay Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court (Special Judge), S.C./S.T., Gaya in connection with Alipur P. S. Case No.60 of 2014. Consequent thereupon, instant appeal is allowed.
