Petitioner seeks bail in a case registered for the offences punishable under Sections 394,397 of the Indian Penal Code.

The FIR of the occurrence of dacoity with murder is against unknown. Petitioner is in custody since 28.02.2020. Submission is that the petitioner was never put on T.I. Parade nor any incriminating article was recovered from his possession. Only on the basis of information of the spy petitioner has been booked in this case. Though the petitioner has got criminal antecedent, however they are cases five years old and on that basis, the petitioner has been booked in this case. Considering the lack of sufficient material for further detention of the petitioner, let the petitioner, above named, be

Patna High Court CR. MISC. No.38574 of 2020(2) dt.01-03-2021 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Benipatti Police Station Case No.226 of 2018 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
