JUSTICE BIRENDRA KUMAR ORAL ORDER 28-06-2019 The petitioners are permitted to correct the name of their husband in the cause title during course of the day. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are languishing in custody for the offences punishable under Sections 341/323/448/307/34 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.

There is general and omnibus allegation against the male and female accused persons to have committed injury to the wife of the informant as a result whereof she died during

Patna High Court CR. MISC. No.39874 of 2019(2) dt.28-06-2019 2/2 the course of treatment. Investigation of the case is already complete.

Considering the general and omnibus allegation and the fact that the petitioners are female having no criminal antecedent and are in custody since 03.02.2019, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Bhawanipur P.S. Case No.02 of 2016, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
