JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-11-2017 The petitioner seeks regular bail in connection with Complaint Case No. 1286 of 2015, registered for offences punishable under Sections 498A/34 of the Indian Penal Code. Submission of learned counsel for the petitioner is that he is still ready to keep in the complainant with himself as a wife with full honour and dignity.

Learned counsel for the complainant has submitted that complainant also want to live with the petitioner if she is not harassed and kept with dignity and care.

In view of the submissions of learned counsel for the petitioner that he is still ready to keep the complainant with full honour and dignity, this application is disposed of with direction

Patna High Court Cr.Misc. No.34831 of 2017 (4) dt.10-11-2017 the Court below to call the petitioner from jail on 27.11.2017, on which date complainant shall also present herself and the court below, shall watch the conduct of the petitioner and if it is found that he is ready to keep his wife with full honour and dignity, he shall enlarge the petitioner on provisional bail to his satisfaction for a period of six months, during which period the petitioner and the complainant shall have to appear in the court below in the first week of each month for a period of six months and the court below only after satisfying himself with the conduct of the petitioner and also after satisfying himself with the status of matrimonial life of the parties, shall confirm the provisional bail of the petitioner, otherwise, he is free to pass any order as he deems fit and proper.

It is also made clear that if complainant is not ready to live with the petitioner without any genuine reasons, in that case also, the court below shall confirm the provisional bail of the petitioner. (Vinod Kumar Sinha, J) sunil/- U T
