2. Heard learned counsel for the petitioner and learned A.P.P for the State.

3. The petitioner has preferred this application for grant of regular bail in connection with Bibhutipur P.S. Case No. 85 of 2023 dated 11.03.2023 registered for the offences u/ss 376, 420, 120B, 272 and 273 of the Indian Penal Code and Sections 3, 5, 7 and 8 of the Immoral Traffic Prevention Act, 1956 and Sections 66E, 67A, 67(B) of the Information and Technology Amendment Act, 2000.

4. As per the prosecution case, one Ex-Mukhiya Surendra Prasad Singh and his companion, Satya Narayan Singh was murdered by unknown miscreants.

5. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.42192 of 2023(2) dt.25-07-2023 2/2 the petitioners is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the coaccused Nitu Kumari. The petitioner is a Block Teacher and posted in Middle School, Girl Chandchaur Mathurapur, Samstipur. There is nothing material against the petitioner except the confessional statement. The petitioner has got two other criminal cases as stated in para 3 of the bail petition. The petitioner is in custody since 27.05.2023.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Bibhutipur P.S. Case No. 85 of 2023.

8. The application stands allowed.
