02. 13.07.2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences under Section 120B/34 of the Indian Penal Code and Section 30A of the Prohibition of Bihar Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 405 bottles each containing 375 ml of foreign liquor were recovered from the Tata Safari which was being boarded by three persons including the petitioner. It is further contended that coaccused namely Sagar Kumar @ Ganga Sagar Choudhary has

Patna High Court Cr.Misc. No.31731 of 2017 (2) dt.13-07-2017 already been granted bail by a Co-ordinate Bench of this Court by order dated 18.05.2017 passed in Cr. Misc. No. 23570 of 2017. Petitioner claims that he is having clean antecedent and is in custody since 26.04.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 4th Additional District & Sessions Judgecum-Special Judge, Excise Act, Bhagalpur in connection with Tatarpur (Vishwavidyalaya) P.S. Case No. 60 of 2017 (G.R. No. 1363 of 2017) with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
