JUSTICE BIRENDRA KUMAR ORAL ORDER 30-07-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The petitioners are in custody since 12.03.2018 in a case registered against unknown for commission of robbery. Submission is that the petitioners have got no criminal antecedent and same is the report of the Superintendent of Police, Nawgachhia received through letter dated 20th July, 2018. The petitioners were never put on TI Parade nor anything was recovered from possession of the petitioners during investigation of the case. Only material is confessional statement of the petitioners as well as co-accused.

No.26424 of 2018 (5) dt.30-07-2018 2/2 Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihpur Police Station Case No. 559 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
