The petitioner apprehends his arrest in Atri P.S. Case No. 90/2015, registered for the offences punishable under Sections 366(A), 379 of the Indian Penal Code.

The informant alleged that when he woke up at about 2.30 am at night, he did not find his wife with him. The informant further alleged that he saw Ravi Ranjan, son of Binay Singh taking his wife. His wife fled away with ornaments.

Learned counsel for the petitioner submits that the informant has only claimed to be legally wedded husband of the girl. The girl is present in the court. She also filed a petition before the learned court below that she voluntarily solemnized marriage with the petitioner.

Patna High Court Cr.Misc. No.40986 of 2015 (3) dt.09-11-2015 2/2 Learned counsel for the informant identified the lady in court and submitted that he has no any objection if she files a petition for her maintenance. The lady has already filed a petition before the learned C.J.M., Gaya that she solemnized marriage with Ravi Ranjan on 10.02.2015.

Having considered the facts that the victim herself appeared in the court and alleged that she voluntarily married with Ravi Ranjan and not with Mothit Kumar, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Jigar Shah, Judicial Magistrate 1st Class, Gaya in connection with Atri P.S. Case No. 90/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
