JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-02-2021 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Digha P.S. Case No. 489 of 2020 for the offence under Sections 419, 420, 467, 468, 471/34 of the Indian Penal Code. Allegation against the petitioners is that they were carrying construction work unauthorizedly on the land belonging to Bihar State Housing Board.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 10.09.2020. He further submits that the petitioner no. 1 purchased the land from an agriculturist (Kisan). In Rajeev Nagar, Patna area large number of

No.39028 of 2020(2) dt.17-02-2021 2/2 constructions were made on the basis of alleged agreement from agriculturist notwithstanding the fact that the land was already acquired by the Bihar State Housing Board, Patna. Considering the aforesaid, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 489 of 2020.
