JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Motihari Town P.S. Case No. 238 of 2018 registered for the offences punishable under Sections 341, 323, 498A, 494, 379 and 34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, East Champaran, Motihari. Allegation against the petitioner, who happens to be husband of the informant, is that he snatched all her belongings and tried to kill her by pressing her neck and thereafter he performed second marriage also.

Submission of learned counsel for the petitioner is that the allegation is false and concocted and he is still ready to reside with opposite party No.2 at Motihari and keep her with dignity and care. Heard learned APP and learned counsel for opposite party No.2. Though stand of opposite party No.2 is that petitioner

Patna High Court CR. MISC. No.40213 of 2019(3) dt.05-09-2019 2/2 solemnized second marriage but in spite of that to save her children's future she wants to reside with the petitioner at Motihari, where she is working.

In view of above facts and circumstances, let petitioner surrender within a period of two weeks and on condition that he has to reside with opposite party No.2 at Motihari he shall be released on provisional bail by the court below itself for a period of six months and during that period the court shall watch their conduct and marital relationship between them by calling them in second week of every month. Once the court is satisfied with their conduct, specially the conduct of petitioner, the court below shall confirmed bail bonds of the petitioner, otherwise the court is free to pass any other order(s) as it may deem fit and proper.

With the above observation, this application is disposed of.
