====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Sections 379, 411/34 of the Indian Penal Code.

It appears from perusal of the fardbeyan that three persons were apprehended at the spot stealing cattle for the purpose of their sacrifice. Petitioner and one Md. Gulab, both have been implicated in the confessional statement of those who have been apprehended at the spot.

It is submitted on behalf of the petitioner that the informant and those apprehended at the spot have already settled the dispute and appreciating such settlement, Md. Gulab has been admitted to the privilege of bail in the event of arrest by another

Patna High Court Cr.Misc. No.41502 of 2015 (2) dt.16-10-2015 2/2 Bench of this Court under order no. 2 dated 17.12.2014 passed in Cr. Misc. No. 44762 of 2014, Annexure-2. It is also submitted that the case of the petitioner is exactly similar to that of Md. Gulab, who has been admitted to the privilege of bail in the event of arrest.

Let petitioner above named surrender in the court of Sub-Divisional Judicial Magistrate, Samastipur in connection with Samastipur (Muffasil) P.S. Case No. 223 of 2014 within four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in the light of Annexure-2.
