The petitioner seeks bail in Gandhi Maidan P. S. Case No. 73 of 2018 instituted for the offence under Section(s) 395 and 397 of the Indian Penal Code.
Learned counsel for petitioner submits that petitioner is not named in the written report. The FIR is against unknown. In the written report it is alleged that informant got message on his telephone that his brother is lying in injured condition at Chiraiyatarpul Tinmuhani and he was being taken to PMCH for treatment by the police. The informant went to Hospital and found his brother in injured condition. He had received five firearm injuries on his person. The police has arrested the petitioner on 29.3.2018 in connection with Kotwali
Patna High Court CR. MISC. No.42922 of 2019(3) dt.02-09-2019 2/2 P.S. case no. 190 of 2018 and thereafter remanded the petitioner in the instant case after recording his confessional statement. No TIP has been held.
Petitioner is in custody since 24.5.2018.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Add. District and Sessions JudgeVI, Patna, in connection with Gandhi Maidan P. S. Case No. 73 of 2018, sessions Trial no. 516 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
