Petitioner seeks regular bail in connection with Lakhnaur PS Case No. 308 of 2019 / G.R. No. 2020 of 2019 registered for the offence under Sections 302 , 201 / 34 of the IPC.
As per the fardbyan of the informant her husband informed her that he was going to attend a party thrown by one Alok Singh at the house of Ajay Singh. It has further been alleged that the husband of the informant did not return till 1.30 A.M. in the night and the next morning i.e. on 10-12-2019 dead body of the informant's husband was found near Kamla bridge. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of

No.51652 of 2021(3) dt.19-05-2022 2/3 the confessional statement of the co-accused / Bigyan Kumari, who is wife of the petitioner and was having illicit relation with the deceased. He further submits that on the basis of CDR that the deceased had a talk with Bigyan Kumari and the confessional statement of the co-accused / Bigyan Kumari he has been implicated in this case. The petitioner is in custody since 20.03.2021 and the co-accused / Bigyan Kumari has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 21504 / 2020. The petitioner is having no criminal antecedent.
Regard being had to the submissions made by the parties, taking into consideration the the fact that the case is based upon circumstantial evidence, the co-accused has been granted bail by a Bench of this Court, petitioner is in custody since 20-03-2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Jhanjharpur / incharge successor court in connection with Lakhnaur PS Case No. 308 of 2019 / G.R. No. 2020 of 2019 on the following condition:- (a) that the petitioner shall remain present on
Patna High Court CR. MISC. No.51652 of 2021(3) dt.19-05-2022 3/3 each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled.
