In this case, the petitioner is seeking anticipatory bail in connection with Sonepur P.S. Case No. 245 of 2019 registered for offence punishable under section 30 (A) of the Bihar Prohibition and Excise Act.
The Police received information that petitioner and other stocked heavy quantity of liquor for influencing the voters, on the basis of information, has raided the house of coaccused Supan Rai, where a huge quantity of illegal liquor was found dump in a ditch, which was to be used at the time of Lok Sabha election. During investigation, the name of petitioner has also surfaced to be involved in the trade of illegal liquor. The counsel for the petitioner submits that it was an
Patna High Court CR. MISC. No.39631 of 2019(2) dt.01-07-2019 2/2 abandoned house which is not any way related to the owner of the house.
Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
