The petitioners seek bail in Asarganj P.S. Case No. 73 of 2015 registered under Sections 147, 148, 149, 307 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioners that no specific overt act has been alleged against the petitioner whereas the specific allegation is against co-accused Pravesh Yadav and Manoj Yadav. It has further been submitted that the petitioner is in custody since 14.09.2016 and other accused persons having similar allegation have been granted bail vide order dated 16.03.2016 passed in Cr. Misc. No. 11717/2016. Heard learned A.P.P. also.

No.54703 of 2016 (2) dt.09-01-2017 2/2 Having heard both sides and in view of the fact that no specific overt act has been alleged against the petitioners and similarly situated co-accused have been granted bail, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Munger in Asarganj P.S. Case No. 73/2015.
